(1) AFFILIATION OF VOLUNTARY ASSOCIATIONS WITH SACNASP

 The new Natural Scientific Professions Act, 2003 Act 27 of 2003) came into effect on 17 February 2004 and brought about a few changes in the way that the natural sciences will be regulated henceforth.

 As far as the scientific societies are concerned, a much closer liaison and working relationship between SACNASP and the societies will be necessary to give effect to the new Act. A very significant change regarding the societies brought about by the new act, is the "Recognition of voluntary associations". (See section 26 of the new Act below):

 

"Recognition of voluntary associations

26.(1) The Council must submit the framework for the requirements for recognition of a voluntary association to the Director-General for approval.

(2)  As soon as the framework is approved, the Council must determine the requirements with which a voluntary association must comply to quality for recognition by the Council.

(3)  Any voluntary association may apply to the Council to recognised as such.

(4)  The Council may, if the voluntary association complies with the requirements determined in terms of subsection (2), recognise that association and issue it with a certificate of recognition.

(5)  A certificate of recognition is valid for a period five years from the date of issue and may on application be renewed for further periods of five years.

(6)  The recognition of a voluntary association lapses - (a)  If that association no longer complies with the requirements determined in terms of subsection (2); or  (b) if no application for renewal had been made, at the expiry of the five-year period referred to in subsection (5).

(7)  The chairperson or head of a voluntary association whose recognition has lapsed must on written demand return the certificate of recognition to the Council.

(8)  A voluntary association must display its certificate of recognition in a conspicuous place at its head office."

The task of submitting the framework (section 26 (1)) to the Director-General, was scheduled for early 2005 and we plan to invite all prospective "voluntary associations" to a workshop where this framework can be discussed before submission. (Copy of the "old" framework included).

The new Act obligates the participation of voluntary associations to ensure the effective functioning of the Council and all its activities. The voluntary associations will be consulted regarding various aspects:

"Nomination procedure"

4.(1)   When any nomination in terms of section 3(1) (a) or (b) becomes necessary, the Minister must invite, the voluntary associations and the State, in the prescribed manner, to nominate persons as members of the Council within a period of at least 30 days from the date of the invitation.

"Identification of work"

27.(1) The Council must consult with all voluntary associations regarding the identification of the type of natural scientific work which may be performed by registered persons.

 

"Professional conduct"

28.(1) The Council must, after consultation with the Director-General, voluntary associations and registered persons, draw up a code of conduct for registered persons.

 

"Professional fees"

35.(1) The Council must annually, after consultation with the voluntary associations and registered persons, determine guideline professional fees and publish those fees in the Gazette.

 THE NATURAL SCIENTIFIC PROFESSIONS ACT, 1993 (ACT 106 OF 1993)

RULES MADE IN TERMS OF SECTION 17 OF THE ACT

 

Under the powers vested in him by section 17 (2) of the Natural Scientific Professions Act, 1993 (Act 106 of 1993), the Minister of Arts, Culture, Science and Tech­nology approved the rules as to the requirements with which a person registered in terms of this Act shall comply in practicing his profession as well as the rules prescribing conduct (apart from conduct referred to in section 13) on the part of a person registered in terms of this Act which shall constitute improper conduct: Refer to the attached schedule.

THE SOUTH AFRICAN COUNCIL FOR NATURAL SCIENTIFIC PROFESSIONS

RULES IN TERMS OF THE NATURAL SCIENTIFIC PROFESSIONS ACT, 1993 (ACT No. 106 OF 1993)

The South African Council for Natural Scientific Pro­fessions has, in terms of section 17 (1) of the Natural Scientific Professions Act, 1993 (Act No. 106 of 1993), made the rules set out in the Schedule.

Notice 649 of 1985 is hereby repealed.

CODE OF PROFESSIONAL CONDUCT

4. A professional natural scientist or a professional natural scientist-in-training or professional natural science technologist or professional natural science technologist-in-training shall in practicing his profes­sion comply with the following code of conduct:

4.1 He shall have due regard to public safety, public health and public interest generally.

4.2 He shall discharge his duties to his employer or client in an efficient manner and with integrity.

4.3 He shall order his conduct so as to uphold the dignity, standing and reputation of the profes­sion.

4.4 He shall not undertake professional natural science work of such a nature that his education, experience or background have not rendered him competent to perform it.

4.5 He shall disclose to his employer or client, in writing, any substantial interest he may have in any company, firm or person carrying on any con­tracting, consulting work or manufacturing busi­ness which is or may be related to the work for which he is employed, as well as particulars of any royalty accruing to him from any article or process used in or for the purpose of the work in respect of which he is employed.

4.6 Subject to rule 4.5, he shall not receive, either directly or indirectly, any gratuity, commis­sion or other financial benefit in respect of any article or process used in or for the purpose of the work in respect of which he is employed, unless such gratuity, commission or other financial bene­fit has been authorised, in writing, by his employer or client.

4.7 He shall not maliciously or recklessly injure, either directly or indirectly, the professional repu­tation, prospects or business of any other profes­sional natural scientist or professional natural scientist-in-training or professional natural science technologist or professional natural science tech­nologist-in-training.

4.8 He shall not knowingly attempt to supplant another professional natural scientist or profes­sional natural scientist-in-training or professional natural science technologist or professional natu­ral science technologist-in-training in a particular engagement after a formal offer has been made to employ the latter.

4.9 He shall not advertise his professional ser­vices in a self-laudatory manner or that is dero­gatory to the dignity of the profession.

4.10 He shall not misrepresent or permit mis­representation of his or his associates' academic or professional qualifications nor exaggerate his or their degree of responsibility for any work of a pro­fessional natural scientific nature.

4.11 He shall not, without a satisfactory reason, destroy calculations or documentary or other evidence required for the verification of his work.

 

4.12 He shall neither personally nor through any other agency attempt to obtain consulting work by way of touting or bribery.

4.13 He shall order his conduct in connection with professional natural scientific work outside the borders of the Republic of South Africa in accord­ance with these rules in so far as they are not inconsistent with the law of the country concerned: Provided that where there are recognised stan­dards of professional conduct in a country outside the Republic, he shall also adhere to those stan­dards.

CONDUCT CONSTITUTING IMPROPER CONDUCT

5. Apart from the conduct referred to in section 13 (1) of the Act, failure on the part of any person registered as a professional natural scientist or a professional natural scientist-in-training or a professional natural science technologist or a professional natural science technologist-in-training to comply with any provision of the code of professional conduct as set out in rule 4, shall constitute improper conduct.

PUNISHMENTS WHICH MAY BE IMPOSED IN RESPECT OF IMPROPER CONDUCT

6.1 A professional natural scientist or a professional natural scientist-in-training or a professional natural science technologist or a professional natural science technologist-in-training who has in terms of the Act or these rules been found guilty of improper conduct, shall be liable to one or more of the following punish­ments:

(a) A reprimand or a caution or a reprimand and a caution.

(b) A fine not exceeding R500.

(c) Suspension from practice for a specified period not exceeding three years.

(d) Removal from the register and –

(i) temporary disqualification from registration in terms of section 11 of the Act for a speed period not exceeding three years; or

(ii) permanent disqualification from registration in terms of section 11 of the Act.

6.2 The Council may, in its discretion and subject to such conditions as it may wish to prescribe, if any

­6.2.1 suspend the operation of any punishment imposed in terms of-rule 6.1 (b) or (c) for a period not exceeding three years from the date on which such punishment is imposed; or

6.2.2 postpone the coming into operation of any punishment imposed in terms of rule 6.1 (c): Pro­vided that the date on which such punishment shall come into operation shall be communicated to the defendant by means of a written notification under the hand of the President addressed to the defendant at his last known address by registered post; or

6.2.3 reduce any punishment imposed in terms of rule 6.1 (b) or (c); or

6.2.4 substitute any other punishment referred to in rule 6.1 for any punishment imposed in terms of rule 6.1 (b), (c) or (d): Provided that the punish­ment substituted in this manner shall not be more severe than the punishment originally imposed.

Die Suid-Afrikaanse Raad vir Natuurwetenskaplike Professies het kragtens ar ikel 17 (1) van die Wet op Natuurwetenskaplike Professies, 1993 (Wet No. 106 van 1993), die reels in die Bylae uitgevaardig. Kennisgewing 649 van 1985 word hierby herroep.

PROFESSIONELE GEDRAGSKODE

4. 'n Professionele natuurwetenskaplike of 'n pro­fessionele natuurwetenskaplike-in-opleiding of 'n pro­fessionele natuurwetenskaplike tegnoloog of 'n professionele natuurwetenskaplike tegnoloog-in­opleiding moet by die beoefening van sy professie die volgende gedragskode nakom:

4.1 Hy moet die openbare veiligheid, openbare gesondheid en openbare belang in die algemeen behoorlik in ag neem.

4.2 Hy moet sy verpligtinge teenoor sy werk­gewer of klient op 'n bevoegde wyse en met integriteit uitvoer.

4.3 Hy moet horn so gedra dat die waardigheid, status en goeie naam van die professie hoog gehou word.

4.4 Hy mag nie professionele natuurweten­skaplike werk onderneem wat van so 'n aard is dat sy opleiding, ondervinding of agtergrond horn nie vir uitvoering daarvoor bekwaam het nie.

4.5 Hy moet enige aansienlike belang wat by het in 'n maatskappy, firma of persoon wat kontrak-, raadgewende of vervaardigingswerk verrig wat verband hou of kan hou met die werk waarvoor by aangestel is, asook besonderhede van enige tan­tieme wat aan horn betaaibaar is vir 'n artikel of proses wat gebruik word in of vir doeleindes van die werk waarvoor by aangestel is, skriftelik aan sy werkgewer of klient openbaar.

4.6 Behoudens reël 4.5, mag by nie regstreeks of onregstreeks enige gratifikasie, kommissie of ander finansiele voordeel ontvang nie vir 'n artikel of proses wat vir doeleindes van die werk waar­voor by aangestel is, gebruik word tensy sodanige gratifikasie, kommissie of ander finansiele voor­deel skriftelik deur sy werkgewer of klient gemag­tig is.

4.7 Hy mag nie kwaadwilliglik of op roekelose "se hetsy regstreeks of onregstreeks, die profes­sionele aansien, vooruitsigte of sake van 'n ander professionele aansien, vooruitsigte of sake van 'n ander professionele natuurwetenskaplike of pro­fessionele natuurwetenskaplike-in-opleiding of professionele natuurwetenskaplike tegnoloog of professionele natuurwetenskaplike tegnoloog-in­opleiding skaad nie.

4.8 Hy mag We willens en wetens pog ings aan­wend om by 'n bepaalde diens 'n ander profes­sionele natuurwetenskaplike of professionele natuurwetenskaplike-in-opleiding of professionele natuurwetenskaplike tegnoloog of professionele natuurwetenskaplike tegnoloog-in-opleiding to verdring nie nadat 'n formele aanbod gemaak is om laasgenoemde to emplojeer.

4.9 Hy mag nie sy professionele dienste op 'n sefverheffende wyse of op 'n wyse wat die waar­digheid van die professie kan skaad, adverteer nie.

4.10 Hy mag nie 'n wanvoorstelling van sy eie akademiese of professionele kwalifikasies of die van sy kollegas gee of toelaat nie of sy of hulle aandeel in enige professionele natuurweten­skaplike werk oordryf nie.

4.11 Hy mag nie, sonder bevredigende redes, berekenings of dokumentere of ander getuienis wat nodig is vir die verifikasie van sy werk, vernietig nie.

4.12 Hy mag nòg persoonlik nòg deur die tus­senkoms van 'n ander by wyse van klantelokking of omkopery, poog om raadgewende werk to verkry.

4.13 Hy moet sy gedrag in verband met profes­sionele natuurwetenskaplike werk buite die Repu­bliek van Suid-Africa skik ooreenkomstig hierdie reels vir soverre hulle nie teenstrydig is met die wette van die betrokke land nie: Met then ver­stande tat waar daar in 'n land buite die Republiek erkende standaarde van professionele gedrag bestaan, by sodanige standaarde ook moet eer­biedig.

 

GEDRAG WAT ONBEHOORLIKE GEDRAG UITMAAK

 

5. Benewens die gedrag vermeld in artikel 13 (1) van die Wet, maak versuim van die kant van iemand wat as 'n professionele natuurwetenskaplike of 'n professionele natuurwetenskaplike-in-opleiding of professionele natuurwetenskaplike tegnoloog of professionele natuurwetenskaplike tegnoloog-in-opleiding geregi­streer is om enige bepaling van die professionele gedragskode vervat in reël 4 na to kom, sodanige per­soon horn aan onbehoorlike gedrag skuldig.

 

STRAWWE WAT VIR ONBEHOORLIKE GEDRAG OPGELE KAN WORD

 

6.1 'n Professionele natuurwetenskaplike of 'n professionele natuurwetenskaplike-in-opleiding of pro­fessionele natuurwetenskaplike tegnoloog of profes­sionele natuurwetenskaplike tegnoloog-in-opleiding wat ingevolge die Wet of hierdie reels aan onbehoor­like gedrag skuldig bevind is, kan een of meer van die volgende strawwe opgele word:

(a) 'n Berisping of 'n waarskuwing of 'n beris­ping en 'n waarskuwing.

(b) 'n Boete van hoogstens R500.

(c) Skorsing in die praktyk vir 'n bepaalde tyd­perk maar hoogstens drie jaar.

(d) Skrapping van die register en-  

(i) tydelike onbevoegdverklaring vir reghstrasie kragtens artikel 11 van die Wet vir 'n bepaalde tydperk maar hoogstens drie jaar; of

(ii) permanente onbevoegdverklaring vir regis­trasie kragtens artkel 11 van die Wet.

6.2 Die Raad kan na goeddunke en onderworpe aan sodanige voorwaardes, as daar is, wat by bepaal-

­6.2.1 die toepassing van 'n straf opgele krag­tens reel 6.1 (b) of (c) vir 'n tydperk van hoogstens drie jaar vanaf die datum van oplegging van soda­nige straf opskort; of

6.2.2 die inwerkingtreding van 'n straf opgele kragtens reel 6.1 (c) uitstel: Met then verstande tat die datum waarop sodanige straf in werking tree, aan die verweerder meegedeel word by wyse van 'n skriftelike kennisgewing wat deur die Presi­dent onderteken en aan die verweerder by sy laaste bekende adres per aangetekende pos gerig is; of

6.2.3 'n straf opgele kragtens reel 6.1 (b) of (c) verminder; of

6.2.4 'n straf opgele kragtens reel 6.1 (b), (c) of (d) deur 'n ander straf in reel 6.1 genoem, ver­vang: Met then verstande tat die straf in die plek daarvan gestel, nie swaarder is as die straf wat oorspronklik opgelê is nie.

NOTICE IN THE GOVERNMENT GAZETTE OF THE SOUTH AFRICAN COUNCIL FOR NATURAL SCIENTIFIC PROFESSIONS

The South African Council for Natural Scientific Pro­fessions can in terms of section 7 (1) (n) of the Natural Scientific Professions Act, 1993 (Act. No. 106 of 1993) prescribe the requirements with which an association of professional natural scientists or professional natu­ral science technologists or a combination thereof shall comply in order to qualify for recognition as a professional natural scientists' association or a professional natural science technologists' association or a combi­nation thereof in terms of the said Act. The require­ments are set out in the attached Schedule.

I approve that these requirements are' published in the Government' Gazette.

SOUTH AFRICAN COUNCIL FOR NATURAL SCIENTIFIC PROFESSIONS REQUIREMENTS WITH WHICH AN ASSOCIATION OF PROFESSIONAL NATURAL SCIENTISTS OR PROFESSIONAL NATURAL SCIENCE TECHNO­LOGISTS SHALL COMPLY IN ORDER TO QUALIFY FOR RECOGNITION AS A PROFESSIONAL NATU­RAL SCIENTISTS' ASSOCIATION OR A PROFES­SIONAL NATURAL SCIENCE TECHNOLOGISTS' ASSOCIATION °OR A COMBINATION THEREOF IN TERMS OF SECTION 7 (1) (n) OF THE NATURAL SCIENTIFIC PROFESSIONS ACT, 1993 (ACT No. 106 OF 1993)

The South African Council for Natural Scientific Pro­fessions has in terms of section 7 (1) (n) of the Natural  Scientific Professions Act, 1993 (Act No. 106 of 1993), prescribed the requirements set out in the Schedule with which an association of professional natural scien­tists or professional natural science technologists or a combination thereof, shall comply in order, to qualify for recognition as a professional natural scientists' asso­ciation or a professional natural science technologists' association or a combination thereof in terms of the said Act.

Notice 648 of 1985 is hereby repealed.

SCHEDULE

1. In this Schedule an expression or a word to which a meaning has been assigned in the Natural' Scientific Professions Act, 1993 (Act 106 of 1993), bears the same meaning and, unless the context otherwise indi­cates­-

"the Act" means the Natural Scientific Professions Act, 1993 (Act 106 of 1993);

"association" means an association of professio­nal natural scientists or of professional natural science technologists or a combination thereof;

"corporate member” means a member of an asso­ciation of professional natural scientists or profes­sional natural science technologists or a combina­tion thereof who has voting rights over the affairs of such association.

                     

2. An association shall be constituted in the Republic of South Africa and shall have no formal connection by way of statute with a foreign counterpart and shall, in terms of its constitution, further the interest or promote the study of at least one discipline belonging to the following groups of natural sciences or related sciences:

(a) Earth sciences;

(b) Chemical sciences;

(c) Physical sciences;

(d) Mathematical sciences;

(e) Biological sciences.

3.1 An association shall have at least 100 corporate members: Provided that the, Council may relax this requirement if it is of the opinion that it would be in the interest of the natural scientist's profession to recog­nize an association having less than 100 corporate members.

3.2 At least two-thirds of the members of the govern­ing body of an association shall be domiciled in the Republic of South Africa.

3.3 At least two-thirds of the corporate members of an association shall­-

3.3.1 be domiciled in the Republic of South Africa; and

3.3.2 be registered as professional natural scientists or as professional natural scientists-in-­training or professional natural science technolo­gists or professional natural science technolo­gists-in-training or shall comply with the requirements prescribed for registration as a professional natural scientist or professional natural scientist-­in-training or as a professional natural science technologist or as a professional natural science technologist-in-training in  terms of the Act.

4.1 An association shall, within 30 days from the date of its adoption, advise the Registrar in writing of any amendments effected to its constitution, bylaws or regulations.

4.2 If the Council is of the opinion that an association in amending its constitution, bylaws or regulations no longer complies with any one or more of the require­ments prescribed herein, the Council may terminate its recognition as an association with effect from a current date.

5.1 Whenever the requirements prescribed herein are amended or supplemented, an association shall, within 12 months from the date of publication of such amendments or supplementary requirements in the Government Gazette, take the steps necessary to comply with such amendments or supplementary requirements: Provided that the Council may, on the application of an association, in its discretion, extend the period referred to for a further period not exceeding 12 months.

5.2 If an association fails or refuses to comply with any amendment or supplementary requirements within the prescribed or extended period the Council may terminate its recognition as a professional natural scientists' association or a professional natural science technologists' association or a combination thereof, with effect from a current date.

Die Suid-Afrikaanse Raad vir Natuurwetenskaplike Professies is bevoeg om kragtens artikel 7 (1) (n) van die Wet, op Natuurwetenskaplike Professies, 1993 (Wet No. 106 van 1993), vereistes voor to skryf waar­aan 'n vereniging van professionele natuurwetenskap­likes of professionele natuurwetenskaplike tegnologoë of 'n kombinasie daarvan, moet voldoen om vir die doeleindes van hierdie Wet, vir erkenning as 'n vereniging van professionele natuurwetenskaplikes of natuurwetenskaplike tegnoloe of 'n kombinasie daar­van, to kwalifiseer en om enige aansoek om sodanige erkenning to oorweeg en daaroor to besluit. Die ver­eistes is vervat in die bygaande Bylae.

Ek keur goed dat hierdie vereistes in die Staats­koerant bekendgemaak word.

VEREISTES WAARAAN ‘N VERENIGING VAN PRO­FESSIONELE NATUURWETENSKAPLIKES OF PROFESSIONELE NATUURWETENSKAPLIKE TEG­NOLOE OF 'N KOMBINASIE DAARVAN MOET VOL­DOEN OM KRAGTENS ARTIKEL 7 (1) (n) VAN DIE WET OP NATUURWETENSKAPLIKE PROFESSIES, 1993 (WET No. 106 VAN 1993), VIR ERKENNING AS 'N VERENIGING VAN PROFESSIONELE NATUUR­WETENSKAPLIKES OF PROFESSIONELE NATUURWETENSKAPLIKE TEGNOLOE OF 'N KOMBINASIE DAARVAN, TE KWALIFISEER

Die, Suid-Afrikaanse Raad vir Natuurwetenskaplike Profesies het kragtens artikel 7 (1) (n) van die Wet op Natuurwetenskaplike Professies, 1993 (Wet No. 106 van 1993), die vereistes in die Bylae voorgeskryf waar­aan 'n vereniging van professionele natuurwetenskap­likes of professionele natuurwetenskaplike tegnoloe of 'n kombinasie daarvan moet voldoen om vir doel­eindes van daardie Wet vir erkenning as 'n vereniging van professionele natuurwetenskaplikes of professio­nele natuurwetenskaplike tegnoloe of 'n kombinasie daarvan, to kwalifiseer.

Kennisgewing 648 van 1985 word hierby herroep.

BYLAE

1. In hierdie Bylae het 'n woord of uitdrukking waar­aan in die Wet op Natuurwetenskaplike Professies, 1993 (Wet 106 van 1993), 'n betekenis geheg is die­selfde betekenis en, tensy uit die samehang anders blyk, beteken-­

"die Wet" die Wet op natuurwetenskaplike Profes­sies,1993 (Wet 106 van 1993);

"vereniging" 'n vereniging van professionele natuurwetenskaplikes of 'n vereniging van profes­sionele natuurwetenskaplike tegnoloe of 'n kombi­nasie daarvan;

"korporaatlid" 'n lid van 'n vereniging van profes­sionele natuurwetenskaplikes of professionele natuurwetenskaplike tegnoloe wat oor stemreg in die sake van sodanige vereniging beskik.

2. 'n Vereniging moet in die Republiek van Suid­Afrika gestig wees en geen formele band kragtens sta­tuut met 'n buitelandse eweknie he nie en moet krag­tens sy grondwet die belange van minstens een dissi­pline behorende tot een van die volgende groepe natuurwetenskappe of verwante wetenskappe behartig of die studie daarvan bevorder:

(a) Aardwetenskappe;

(b) Chemiese wetenskappe;

(c) Fisiese wetenskappe;

(d) Wiskundige wetenskappe;

(e) Biologiese wetenskappe.

3.1 'n Vereniging moet minstens 100 korporaatlede hê: Met dien verstande tat die Raad hierdie vereiste kan verslap indien by die mening huldig tat tit in be­lang van die natuurwetenskaplike professie sal wees om 'n vereniging to erken wat minder as 100 korporaat­lede het.            .

3.2 Minstens twee derdes van die lede van die bestuursliggaam van 'n vereniging moet in die Repub­liek van Suid-Afrika woonagtig wees.

3.3 Minstens twee derdes van die korporaatlede van 'n vereniging moet­-

3.3.1 in die Republiek van Suid-Afrika woonag­tig wees; en

3.3.2 as professionele natuurwetenskaplikes of as professionele natuurwetenskaplikes-in-oplei­ding of as professionele natuurwetenskaplike teg­noloë of as professionele natuurwetenskaplike tegnoloë-in-opleiding geregistreer wees of aan die vereistes kragtens die Wet voorgeskryf vir regi­strasie as professionele natuurwetenskaplike of professionele natuurwetenskaplike-in-opleiding of professionele natuurwetenskaplike tegnoloog of professionele natuurwetenskaplike tegnoloog-in­opleiding, voldoen.

4.1 'n Vereniging moet binne 30 dae vanaf die datum van aanvaarding van enige wysigings aan sy grondwet, verordeninge of regulasies die Registrateur skriftelik daarvan verwittig.

4.2 Indien die Raad van oordeel is dat 'n vereniging deur die wysiging van sy grondwet, verordeninge of regulasies nie meer aan een of meer van die hierin voorgeskrewe vereistes voldoen nie, kan die Raad die erkenning van sodanige vereniging as 'n vereniging vanaf 'n lopende datum intrek.

5.1 Wanneer die hierin voorgeskrewe vereistes gewysig of aangevul word, moet 'n vereniging binne 'n tydperk van 12 maande vanaf die datum van afkondi­ging van sodanige gewysigde of aanvullende vereistes in die Staatskoerant, die nodige stappe doen om to voldoen aan die gewysigde of aanvullende vereistes: Met dien verstande tat die Raad, op aansoek van 'n vereniging, na goeddunke die tydperk voormeld met hoogstens 12 maande kan verleng.

5.2 Indien 'n vereniging versuim of weier om aan enige van die gewysigde of aanvullende vereistes binne die voorgeskrewe of verlengde tydperk to vol­doen, kan die Raad die erkenning van sodanige vere­niging as 'n vereniging van professionele natuur­wetenskaplikes of 'n vereniging van professionele natuurwetenskaplike tegnoloë of 'n kombinasie daar­van, vanaf 'n lopende datum intrek.

SOUTH AFRICAN COUNCIL FOR NATURAL SCIENTIFIC PROFESSIONS

The South African Council for Natural Scientific Professions herewith retract Board Notice 57 of 2002 as published on 7 June 2002 in Government Gazette No. 23470.

The South African Council for Natural Scientific Professions has under article 35 (1) of the Natural Scientific Professions Act; 2003 (Act 27 of 2003), determined the amended tariff of recommended fees in this Schedule, which has been approved.

SCHEDULE

Definitions

1.             In this Schedule the definitions are as follows:

"Category A", in respect of a private consulting practice in natural sciences, shall mean a top practitioner whose expertise is. nationally or internationally recognised and who provides advice at a level of specialisation where such advice is recognized as that of an expert;

"Category B", in respect of a private consulting practice in natural sciences, shall mean a partner, a sole proprietor, a director, or a member who, jointly or severally with his other partners, co-directors or co-members, bears the risk of the business, takes full responsibility for the liabilities of such practice, performs work of a conceptual nature in natural sciences and development, provides strategy guidance in planning and executing a project and/or carries responsibility for quality management pertaining to a project;

"Category C", in respect of a private practice in natural sciences, shall mean all salaried professional and technical staff performing work of a natural scientific nature and who carry the direct technical responsibility for one or more specific activities related to a project. A person referred to in Category B may also fall in this category if such person performs work of a natural scientific nature at this level;

"Category D", in respect of a private consulting practice in natural sciences, shall mean all other salaried technical staff with adequate expertise and relevant experience performing work of a natural scientific nature with direction and control provided by any person contemplated in Categories A or B or C.
